Nook Terms of Service

Welcome, and thank you for your interest in Nook (“Nook,” “we,” “us,” or “our”). These Terms of Service are a legally binding contract between you and Nook regarding your use of the app and related services (collectively, the “Service”).
PLEASE READ THE FOLLOWING TERMS CAREFULLY:
BY CREATING AN ACCOUNT, SUBSCRIBING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING NOOK’S PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.
1. Service Overview
Nook provides information, insights, and recommendations about the materials and potential health or environmental impacts of household products. These insights may be based on user-uploaded product photos, barcodes, product data, or other information provided by or accessible to Nook.
The Service is for informational purposes only. The information provided by Nook is not a substitute for professional medical advice, toxicology analysis, environmental testing, or safety certification. You should consult qualified professionals with any questions regarding health concerns, chemical sensitivities, or product safety.
2. Eligibility
You must create an account using sign-in options provided by Apple or Google to access the Service. By creating an account, you represent that all information provided is accurate and up to date.
3. Accounts and Subscription Fees
Account Creation: To access the Service, you must sign in using Apple or Google. You are responsible for maintaining the confidentiality of your account and password. Nook is not liable for any unauthorized activity on your account.
Subscription Fees: Certain features of the Service may require a subscription. All fees are in U.S. Dollars and are non-refundable unless explicitly stated otherwise. Fees are billed automatically on a recurring basis unless canceled before the next billing cycle.
Changes to Pricing: Nook reserves the right to change subscription pricing with advance notice to users.
4. Use of Third-Party Services
Nook may integrate with third-party tools for analytics, data storage, affiliate linking, image processing, or product information. Your use of the Service is subject to these third-party tools' terms and conditions, which are incorporated into these Terms by reference. Nook is not responsible for the practices of third-party services.
5. Affiliate Relationships
Nook may include affiliate links to products or services offered by third parties, including Amazon.com and other retailers. When users click these links and make purchases, Nook may earn a commission at no additional cost to the user.
As an Amazon Associate, Nook earns from qualifying purchases. Amazon and other affiliate partners do not sponsor, endorse, or assume responsibility for Nook’s content.
We do not offer discounts, rebates, or incentives in exchange for using our affiliate links. Product prices and availability are subject to change without notice, and the information displayed on the retailer’s site at the time of purchase governs the transaction.
Amazon trademarks, logos, and content are the property of Amazon and are used under license in accordance with their Associates Program policies.
6. Prohibited Conduct
By using the Service, you agree not to:
- Use the Service for illegal or unauthorized purposes.
- Upload content that infringes intellectual property rights or violates applicable laws.
- Harass, threaten, or harm other users.
- Interfere with the Service’s operation or security features.
- Reverse-engineer, decompile, or attempt to access the Service’s source code.
- Use bots, crawlers, or similar automated tools to access the Service.
Nook reserves the right to suspend or terminate accounts that violate these terms.
7. Termination
We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including a breach of these Terms. Upon termination, your right to use the Service will cease immediately.
8. Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of Nook and its suppliers under any provision of these Terms and your exclusive remedy shall be limited to the amount actually paid by you through the Service or 100 USD if you haven't purchased anything.
To the maximum extent permitted by applicable law, Nook and its suppliers are not liable for any special, incidental, indirect, or consequential damages, including loss of profits, data, business interruption, personal injury, or privacy loss, arising from or related to your use of the Service.
Some jurisdictions do not allow certain limitations, so some of the above may not apply in those jurisdictions.
9. "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind. To the maximum extent permitted under applicable law, Nook disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
Nook makes no warranty that the Service will:
- Meet your requirements
- Achieve intended results
- Operate without interruption
- Be error-free or that defects will be corrected
10. Disputes Resolution
If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at support@asknook.com.
11. For EU Users
If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.
12. United States Legal Compliance
You represent and warrant that:
- You are not located in a country subject to a U.S. government embargo
- You are not listed on any U.S. government list of prohibited or restricted parties
13. Severability
If any provision of these Terms is held unenforceable, that provision will be interpreted to accomplish its purpose to the greatest extent possible. The remaining provisions will continue in full force and effect.
14. Waiver
A failure to enforce any right or obligation under these Terms does not constitute a waiver of future enforcement.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
16. Changes to the Service or Terms
Nook may modify or discontinue the Service at any time. Material changes to these Terms will be communicated with at least 30 days' notice. Continued use of the Service after changes take effect constitutes acceptance.
17. Product Safety and Misuse
Nook does not guarantee the safety, performance, or suitability of any third-party products. Nook’s product scores, recommendations, and information are provided for general informational purposes only and do not constitute professional safety evaluations. Product use is at your own risk.
